Probate and Estates

When you hire Eastwood Estate and Probate Law, you're hiring a team of probate professionals who know probate matters can be a little confusing, and that's why we walk you through each step of the process. Our goal is to bend over backwards to provide you with the best service possible so that you are at ease during the administration of your loved one's estate.

Our firm prepares all pleadings, such as petitions to probate a will, petitions for letters testamentary or letters of administration, consents and waivers of notice for the next-of-kin, petitions to sell real property, and petitions to sell personal property, in addition to inventories, and petitions to close estates by final settlement or consent settlement. We also know the ins and outs of unique jurisdictional requirements for bonds and renunciations of the county administrator (when applicable by statute).

We believe the key to excellent estate administration legal representation is in client communication and attention to detail. We work with our client's to find assets and, when required, pay the decedent's debts. We help manage relationships with next-of-kin and a decedent's beneficiaries to ensure they understand our client's authority as estate executor or estate administration.

Estate and Trust Administration

When a person dies (for probate or estate administration) or when certain conditions are met (for trust administration, coming of age, a death of a last lineal heir, or other condition), a personal representative, estate administrator, or trustee will often need to go through the probate court to close out an estate or to ensure a trust is properly terminated and funded. Our firm understands the difficult time you and your family may be experiencing with the loss of a loved one. Also, after such a loss, family dynamics may sometimes shift and cause once calm relationships to quickly shift into hostile relationships filled with distrusts. Our firm works with you to ensure that your loved one's estate or trust is correctly and efficiently probated from start to finish.

Estate and Trust Litigation

Litigation is a passion at our firm. We are never more at home than when we are in a courtroom. However, we understand that not every estate and probate case requires litigation. We work hard to resolve matters through peaceable meals before initiating legal proceedings in probate court or circuit court to handle an estate matter. We excel at trial work (both jury and non-jury trials), and we have recovered thousands of dollars for our clients to prove it. The firm has experience representing a broad cross section of individuals and companies and knows probate and civil procedure equally well. We are licensed to practice in state, federal, and appellate courts statewide.
